Privacy Policy
How we collect, use, share and protect the information you give us when you visit this website, contact us, or apply for business funding.
1. Who we are
Falcon Equity Group (“Falcon”, “we”, “us”, “our”) provides business funding from 11 Broadway Suite 615, New York, NY 10004. This policy explains what we do with information we collect through falconequity.ai (the “site”), when you contact us, and when you apply for or use our products.
It applies to individuals: business owners, principals, guarantors and anyone authorised to act for a business. When you use the site or apply for a business, “you” means both you personally and the business you represent.
This policy does not cover what other companies do with your information. See section 11.
2. Information you give us
We collect what you choose to send us, including:
- Contact details — your name, email address, phone number, business name and address, your role, and anything you write in a message or form.
- Application details — your business's legal name, entity type, industry, time in business, ownership and revenue figures, and the documents we ask for. Our current application asks for six months of business bank statements, a government-issued photo ID, a voided check from the business account and a schedule of any open advances or loans.
- Financial information — bank account details, card-processing or sales figures, existing advances or loans, and any credit information you give us.
- Identity information — where we need to verify who you are, your date of birth, Social Security number or employer identification number, and identification documents.
- Communications — emails, notes from calls, and anything you submit through our website forms.
If you give us information about someone else — a co-owner, a guarantor, your accountant — you confirm that you are allowed to share it and that they understand how we use it.
3. Information we collect automatically
When you visit the site, our web server records standard technical information: your IP address, browser and device type, the pages you request, the page that referred you, and the time of the request. We use this to keep the site running, to understand which pages are used, and to detect abuse.
We use Google Analytics to understand how visitors find and use the site: which pages are viewed, how people arrive (for example from a Google search), and general device and location information. Google Analytics uses cookies and similar technology to collect this on our behalf. We use it only to measure and improve the site, not for advertising, and we do not send it the information you enter in our application form. You can read how Google uses this data at policies.google.com/technologies/partner-sites.
We do not run advertising tracking on this site. If we add it, we will update this section first and, where the law requires, ask for your consent before it starts.
4. Information we receive from others
- Credit reporting agencies, for business reports and, where permitted, consumer reports.
- Identity verification, fraud prevention and anti-money-laundering providers.
- Banks and financial data providers, where you authorise us to retrieve account or transaction data.
- Referral partners, brokers and lead sources that introduce you to us.
- Public records and government sources.
- Service providers who operate parts of our site and forms.
5. How we use your information
Assessing and running your funding
- Answer your enquiry and confirm who you are.
- Assess your application, verify the information in it and make a decision.
- Prepare and issue documents, fund, and service the account afterwards.
- Take and reconcile payments, and collect amounts owed.
Running our business
- Keep records, and monitor, test and improve the site and our process.
- Train our team and check the quality of our work.
- Prevent and investigate fraud, and protect our systems and our rights.
Communicating with you
- Respond to you, and send messages about an application or an active account.
- Send you information about products that may fit your business, where the law allows. You can stop marketing messages at any time — see section 8.
Legal and aggregated uses
- Comply with the law, and respond to lawful requests from regulators, courts and law enforcement.
- Enforce our agreements and defend legal claims.
- Create summary reports that do not identify you or your business, which we may use and share.
6. Who we share information with
We share information only as described here, and only with parties who need it:
- Funding partners and lenders — where the product, or your file, calls for it, we share your application with a funder or funding partner so they can assess it.
- Service providers working for us — hosting, application forms, identity checks, credit data, document storage, email and phone, and analytics, under contracts that limit what they can do with it.
- Professional advisers — lawyers, accountants, auditors and insurers.
- Credit bureaus and fraud-prevention databases.
- Regulators, courts and law enforcement, where the law requires or permits it.
- A buyer or successor — if we merge, are acquired, raise finance or sell assets, information may transfer as part of that transaction, and will stay subject to this policy.
- Anyone else you tell us to share it with.
We do not sell your personal information. We do not share it for cross-context behavioural advertising.
7. Cookies and similar technologies
This site does not set cookies for advertising. It uses Google Analytics cookies to measure how the site is used (see section 3). The pages work without them.
To stop Google Analytics, you can block or delete its cookies in your browser, install Google's Analytics opt-out add-on, or turn on Global Privacy Control in your browser — when it is on, this site does not load Google Analytics at all.
Our application form is provided by Jotform and loads in an embedded frame. Jotform may set cookies that the form needs in order to work, and its own privacy policy governs what it does with them.
Your browser lets you refuse or delete cookies. If you block the form's cookies the form may not work; in that case open the form directly, or call us and we will take the details another way.
Where the law requires us to honour a browser opt-out preference signal such as Global Privacy Control, we do. We do not currently respond to “Do Not Track” signals, because there is still no agreed standard for what one means.
8. Your choices and your rights
Marketing
Every marketing email has an unsubscribe link. You can reply STOP to a text, or tell us on a call or by email. Stopping marketing does not stop messages about an application or an active account — we still have to send you those.
Access and correction
Email information@falconequity.ai to ask what we hold about you, or to correct something that is wrong. We may need to verify who you are first. We cannot change records we are required to keep, or information that forms part of a signed agreement.
State privacy rights
If you live in a state with a consumer privacy law — California, Colorado, Connecticut, Virginia and others — you may have the right to know what we collect, to access it, to correct it, to delete it, to get a copy, to opt out of sale, sharing or targeted advertising, and not to be treated differently for exercising those rights.
Send requests to information@falconequity.ai with “Privacy request” in the subject line. An authorised agent may act for you with your written permission. If we refuse a request, tell us and we will look at it again.
Part of what we hold is information about your business rather than about you personally, and some of these laws do not cover business information. If that is why we cannot action a request, we will tell you so.
Nevada
Nevada residents may ask to be placed on our do-not-call list for sales calls. Email us at the address above.
9. Security
We use administrative, technical and physical safeguards that are reasonable for the information we hold: access is limited to people who need it, and information sent through this site is encrypted in transit.
No system is completely secure, and email is not a secure channel. If you would rather not email bank statements or identification, call us and we will arrange another way to send them. If a breach ever affects your information, we will notify you and the regulators as the law requires.
10. How long we keep information
We keep application and account records while you are a customer, and afterwards for as long as our legal, tax, accounting and regulatory obligations require — usually several years. Records we may need to defend a legal claim are kept until that claim is resolved. Enquiries that never become applications are kept for a shorter period. After that we delete the information or remove what identifies you.
11. Other sites and services
The site links to other websites and services — including our application form, our social media account, and partner links in the footer. We do not control those sites, and their own privacy policies apply to them.
Some links on this site are affiliate or referral links. If you use one and become a customer, we may be paid a commission. It costs you nothing extra, and it does not change what we tell you about our own products.
12. If our business changes hands
If we merge with another business, are acquired, or sell or transfer our assets, the information we hold may be part of that transaction. It stays protected by this policy until it is transferred, and the new owner's policy applies from then on.
13. Children
This site and our products are for businesses, and for people who are at least 18. We do not knowingly collect information from children. If you believe a child has given us information, contact us and we will delete it.
14. Changes to this policy
We may update this policy. When we do, we change the date at the top of the page. If a change is material, we will post a notice on the site or contact you directly. Please check back from time to time.
