Terms & Conditions
The rules for using this website, and what to expect when you apply for business funding with Falcon Equity Group.
1. These terms
These terms govern your use of falconequity.ai (the “site”). By using the site you agree to them. If you do not agree, please do not use the site.
They are not the agreement for your funding. If we approve you, the documents you sign for that funding are a separate contract. Where these terms and your funding documents disagree, your funding documents govern the funding.
2. Who we are, and who these terms are for
Falcon Equity Group, 11 Broadway Suite 615, New York, NY 10004, United States.
This site and our products are for businesses in the United States, and for people who are at least 18 and authorised to act for the business they represent.
We fund businesses, not consumers. Every product we offer is for a business purpose. By applying you confirm you are not seeking credit for personal, family or household purposes.
When you use the site or apply for a business, “you” means both you personally and that business, and you confirm you can bind it.
3. What this website is — and is not
The site describes our products, publishes general information about business funding, and lets you start an application. It is not:
- an offer, promise or commitment to fund you;
- a quote, or a guarantee of any amount, cost, term or timing;
- advice of any kind — see section 13.
Where the site mentions timing, such as funding in as little as 24–48 hours, that assumes a complete file, an approved application and a signed agreement. It is not a promise for your particular file.
4. Our products, and the agreement that governs them
The product pages summarise what we offer. They do not contain the terms of any funding. If we approve you, you will receive documents setting out the amount, the cost, the term or remittance schedule, any fees, and the personal guarantee. Read them before you sign — those documents control.
Where a state requires us to give you a written disclosure of the cost of financing before you sign, we provide it first.
Some funding is provided with a funding partner. Where that applies, the partner's documents may also govern your funding, and they will identify who is funding you.
5. Applying
When you submit an application, you confirm that:
- the person submitting it is authorised to act for the business;
- you are of the age of majority where you live;
- everything you give us is true, accurate and complete;
- you will tell us promptly if anything material changes, including your financial condition, while an application or an account is open;
- the application is for a business purpose.
We rely on that information, and so may any funding partner. We may verify it with third parties, and we may decline an application — or offer different terms than you expected — on the basis of what we find.
6. Credit, bank and background checks
By submitting an application you authorise us, our agents, our service providers and any funding partner assessing your file to:
- obtain business credit reports, and consumer credit reports where the law permits, about you and any owner or guarantor;
- contact third parties to verify what you have told us;
- check public records and fraud-prevention databases;
- obtain and review business bank account or transaction data, where you have authorised access to it.
This authorisation applies while your application is assessed and, if you are funded, during the life of the account for reviews, renewals and collections.
Depending on the product, a credit inquiry may be recorded with a credit bureau. Under the Fair Credit Reporting Act you may ask us whether we obtained a consumer report about you, and you can obtain a copy of that report from the agency that supplied it.
7. If we decline your application
We will tell you our decision. Where the law requires us to give you a statement of the reasons, we will give you one, and you can contact us to ask about it. If you believe information in a credit report is inaccurate, you can dispute it directly with the credit bureau that supplied it — that is often the fastest route.
8. Fees and cost
Falcon charges a 0% agreement fee. The cost of your funding is the amount you repay under your agreement, and it is set out in full in the documents you receive before you sign. Rates and costs are competitive and depend on your business profile, the product and the term.
Nothing on this website is a quote, and no cost shown here binds us.
9. Electronic records and signatures
We may communicate with you electronically, and we may ask you to sign electronically. By applying, you consent to receive agreements, disclosures, notices and statements electronically, and you agree that an electronic signature is as binding as a handwritten one.
- Keep copies of anything you sign, and of these terms.
- Tell us promptly if your email address changes.
- You can ask for a paper copy of any document you have signed, and you can withdraw your consent to electronic records by contacting us. If you withdraw it, we may not be able to keep assessing an application online.
10. Calls, texts and messages
By giving us a phone number you agree that we, and service providers acting for us, may call and text you about your application and your account at that number — including using automated technology, an automatic telephone dialling system and prerecorded messages — even if the number is on a federal, state or internal do-not-call registry.
- Consent to marketing calls and texts is not a condition of getting funding. Where the law requires your separate consent for marketing, we ask for it separately.
- Message and data rates may apply, depending on your mobile plan, and frequency varies.
- Reply STOP to any text to stop texts, or HELP for help. You can also tell us on the call, or email us.
- Stopping marketing messages does not stop servicing messages about an application or an active account while you have one.
11. Using this website
You agree not to:
- use the site for anything unlawful, or in breach of these terms;
- try to reach any part of the site, server or system you are not authorised to reach, or get around a security or access control;
- interfere with the site, or with anyone else's use of it;
- upload anything malicious, or transmit a virus, worm or other harmful code;
- scrape, crawl, mine or automate access, except as a public search engine indexing the site under our robots.txt;
- misrepresent who you are, or submit information about someone else without authority;
- copy the site or its content to build a competing product or service.
We may suspend or block access to the site if we believe you have breached these terms.
12. Our content
The site and everything on it — text, layout, graphics, logos, images and code — belongs to us or is licensed to us, and is protected by copyright and trademark law. You may view and print pages for your own business use.
You may not copy, republish, distribute, sell, mirror or create derivative works from our content, or use it to train a model or build a competing service, without our written permission. “Falcon Equity Group” and our marks belong to us.
13. No advice
We are a funding provider. We do not give legal, tax, accounting, investment or financial advice, and nothing on this site is advice or a recommendation to you. Our blog posts and guides are general information — they cannot account for your circumstances. Speak to your own adviser before making a decision.
14. Third-party links
The site links to other websites, and some of those links are affiliate or referral links: if you use one and become a customer of that business, we may be paid a commission. It costs you nothing extra.
A link is not an endorsement. We do not control those sites, and we are not responsible for their content, their products or their privacy practices.
15. Disclaimers
The site is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose and non-infringement.
We do not warrant that the site will be available, uninterrupted or free of errors, or that its content is complete or current. Nothing in these terms excludes a warranty or right that cannot lawfully be excluded.
16. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data, goodwill or business opportunity, arising out of your use of, or inability to use, the site.
Our total liability for all claims relating to the site is limited to one hundred US dollars (USD 100). This section does not limit any liability that cannot be limited by law, and it does not change the liability provisions in any funding agreement you sign.
17. Indemnity
To the extent the law allows, you agree to indemnify us and hold us harmless from claims, losses, liabilities and reasonable legal costs arising out of your breach of these terms, or your misuse of the site.
18. Disputes: please talk to us first
If something has gone wrong, contact us first — most problems are resolved that way. Send a written description of the issue and what you would like us to do to information@falconequity.ai with “Notice of dispute” in the subject line, and give us 30 days to try to put it right.
19. Arbitration and class action waiver
If we cannot resolve a dispute that way, you and we agree to resolve it through binding individual arbitration rather than in court, administered by the American Arbitration Association under its Commercial Arbitration Rules. The Federal Arbitration Act governs this section.
- Either side may bring an individual claim in a small claims court that has jurisdiction, instead of arbitration.
- You may opt out of this section: send written notice to our address in section 23 within 30 days of first accepting these terms. Opting out does not affect anything else in these terms.
- To the extent the law allows, each side waives the right to a jury trial, and the right to bring or take part in a class, collective or representative action.
- Nothing in this section stops either side from asking a court for temporary relief to protect its rights while an arbitration proceeds, or from bringing a claim that the law says cannot be arbitrated.
- If any part of this section is found unenforceable as to a particular claim, that claim goes to court and the rest of this section stands.
20. Governing law
These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Subject to section 19, the state and federal courts sitting in New York County, New York have exclusive jurisdiction over any dispute about these terms.
21. Changes to these terms
We may change these terms. When we do, we change the date at the top of this page, and continuing to use the site means you accept the version in force at the time. The terms that apply to your funding are the ones in your funding documents, not these.
22. General
- If any provision is found unenforceable, it is limited to the minimum extent necessary and the rest of these terms stay in force.
- Our failure to enforce a provision is not a waiver of it.
- You may not transfer your rights under these terms. We may transfer ours to an affiliate or a successor.
- These terms, together with our Privacy Policy, are the whole agreement between us about your use of the site.
- Headings are for convenience only.
